Jeff Sessions to make 'major sanctuary jurisdiction announcement' tomorrow in Sacramento

Trump administration sues California over laws protecting immigrants

Sessions' appearance at California's capital comes less than two weeks after Oakland Mayor Libby Schaaf warned residents of an imminent raid by federal immigration agents, a move harshly criticized by ICE.

Supporters of the laws argue they make communities safer by encouraging undocumented victims of crime to come forward without fear of being detained.

The administration has lost in majority, especially in its efforts to restrict immigration from a number of mostly Muslim countries.

In a statement released about the new lawsuit, Homeland Security Secretary Kirstjen Nielsen said: "California has chosen to purposefully contradict the will and responsibility of the Congress to protect our homeland".

Administration officials charge that the state measures not only hinder their ability to carry out federal law, but also put immigration agents and communities at risk. Administration officials, who briefed reporters before the suit was filed, said other states that are pursuing laws similar to California's are also likely to be targeted in court.

"At a time of unprecedented political turmoil, Jeff Sessions has come to California to further divide and polarize America", the Democratic lawmaker tweeted.

Sessions is expected to formally announce the lawsuit, which will name as defendants the state ofCalifornia, Governor Jerry Brown and the state's attorney general, Xavier Becerra, during a speech on Wednesday morning in Sacramento. Jeff, these political stunts may be the norm in Washington, but they don't work here. SAD!

"I say, bring it on", said California Senate President Pro Tem Kevin de Leon, a Los Angeles Democrat who wrote the sanctuary state bill.

The state laws being challenged were a response to President Donald Trump's hawkish immigration policies and widespread fear in immigrant communities following a campaign in which he promised to sharply ramp up the deportation of people living in the USA illegally. Gen. Jeff Sessions is suing CA because we refuse to help the Trump administration tear apart honest, hardworking immigrant families. "We didn't pass these laws to protect people with serious criminal backgrounds".

Carol Leveroni, executive director of the 20,000-member California Peace Officers Association, said they invited Sessions in hopes of gaining clarity on how law enforcement can follow California's sanctuary state law, Senate Bill 54, while still following federal mandates.

The Trump administration is seeking to block provisions of the law that stop local law enforcement from telling Immigration and Customs Enforcement when they will release certain individuals and from facilitating their transfer unless they've committed certain crimes.

The Trump administration and the Justice Department have been waging an increasingly acrimonious battle with sanctuary jurisdictions, although the lawsuit is perhaps the most consequential step yet. The suit includes a declaration from Immigration and Customs Enforcement Acting Director Thomas Homan, who said that the inability of ICE officers to go to local lockups to pick up immigrants who have been detained by local police agencies forces them to hunt down suspects in more unsafe settings. The DOJ does not plan to argue that Section 1373 requires local law enforcement to hold people exclusively based on ICE requests ― known as "detainers" ― which many jurisdictions have rejected based on cost and constitutionality concerns.
