Congress to Vote on Reversing FCC's Net Neutrality Repeal

Other states are also considering legislation to re-enact net neutrality rules on a local basis while activists groups and several state attorneys general have sued the FCC to stop the repeal of the rule.

A Senate bill that would reverse the Federal Communications Commission's (FCC) decision to repeal net neutrality received its 30th co-sponsor on Monday, ensuring it will receive a vote on the Senate floor. The bill says that "No internet service provide engaged int he provision of fixed or mobile broadband Internet access service shall impair or degrade lawful Internet traffic on the basis of content, application, or service or use of a non harmful device, subject to reasonable network management".

Sen. Scott Wiener, D-San Francisco, promoted dueling legislation - now in the form of spot bill SB 822 - stating the Legislature's intent to "effectuate net neutrality in California utilizing the state's regulatory powers".

Senator Ed Markey announced on Twitter that he now has enough votes to bring the FCC net neutrality rules to a vote under the Congressional Review Act.

The rules would allow Internet Service Providers to block online content, or charge websites for faster delivery to consumers, by rolling back the protections against such actions that were adopted in 2015.

Over in Vermont, Senator Bernie Sanders hasn't made any official moves just yet, but like Senator Bennet, his position is clear.




The resolution was drafted under the Congressional Review Act, which gives Congress the authority to overturn new regulations issued by federal agencies on a simple majority vote of both houses.

And if that was the end of the process, the resolution might have a chance of getting signed into law. The resolution needs all Democratic senators, and two Republicans, to vote in favor of it to pass. A University of Maryland poll last month found they were supported by 83% of Americans, including 75% of Republicans.

"The final version of Chairman Pai's rule, as expected, dismantles popular net neutrality protections for consumers", said Internet Association President & CEO Michael Beckerman.

The U.S. Senate will hold a vote on net neutrality - albeit a symbolic one.

The Nebraska Telecommunications Association, which said it would study Morfeld's bill before taking a position on it, circulated a white paper among its 30 member companies a year ago describing the 2015 rules as trying "to fit a square peg in a round hole".

Before this, a lot of the same big tech companies were fairly passive and inactive during the initial protests of the repeal.
