Waymo Trial Delayed Again With Sharp Words for Uber From Judge

Judge delays Uber-Alphabet trial citing withheld evidence: 'The public is going to hear everything'

Jacobs disputed some of the letter's contents in his testimony, including a claim that Uber stole trade secrets from Waymo. "I had questions about the ethics of it".

"There was legal training around the use of attorney-client privilege markings on written materials and the implementation of encrypted and ephemeral communications meant to destroy communications that might be considered sensitive", Jacobs said.

Alsup voiced his own concern over what he called potentially criminal conduct involving a hidden system of messaging at Uber.

Waymo sued Uber, saying that they stole trade secrets about self-driving auto technology.

"I can no longer trust the words of the lawyers for Uber in this case", Alsup said. The letter-which was obtained by the US Attorneys Office during a criminal investigation separate from Waymo's lawsuit-says that Uber's Marketplace Analytics team worked on secret servers and devices that couldn't be traced to Uber in order to dig up information, private code, and trade secrets from competitors. Over the past year, Uber has been rocked by revelations of rampant sexual harassment inside the company, technological trickery created to thwart regulators and a yearlong cover-up of a hacking attack that stole the personal information of 57 million passengers and 600,000 drivers.

Waymo said that it had learned about the letter last week from the Department of Justice, according to MSNBC. He said Uber had even gone as far as to hire former Central Intelligence Agency agents via contractors in its bid to obtain information on its rivals.




Waymo said that Uber intentionally hid key evidence in the case, and it needed more time to prepare for trial now that the evidence has come to light. "And there is a 50-50 chance that this will turn out to be a dry hole".

The existence of such a unit deals a huge blow to Uber's argument that it never used or even saw the 4,000 documents that Levandowski secretly downloaded while still working at Waymo - a fact that was only discovered months later during a security audit.

The judge overseeing the high-stakes trade-theft lawsuit between Uber and Alphabet's autonomous vehicle unit Waymo delayed the trial at a hearing in San Francisco on Tuesday, according to Bloomberg. A new start date hasn't been set. The case centers around former Google employee Anthony Levandowski, who allegedly stole 14,000 "highly confidential" files before leaving the company to start his own self-driving truck startup. Uber paid $680 million a year ago for a self-driving vehicle startup founded by Levandowski after he left Waymo in January 2016.

Uber identified employees at rival companies it believed it could flip in pursuit of competitors' secrets.

Softbank, the Japanese firm leading the proposed investment, is proposing to buy the shares at a 30 percent discount from Uber's previous valuation of roughly $68 billion, according to multiple media reports citing unnamed people familiar with the terms.
