Video expected at hearing in Penn State pledge's death case

Prosecutors say the hearing at a courthouse near campus - set to start at 8:30 a.m. - could take much or all of the day.

UPDATE: On Monday a spokesperson for the fraternity told "CBS This Morning", "As these hearings begin, Beta Theta Pi International Fraternity has confidence in the judicial system that due process and justice can and will be served".

Most of the 18 fraternity members facing charges related to the alleged hazing death of a Penn State University pledge are expected in court Monday as prosecutors plan to play about three hours of security video from the Beta Theta Pi house during the last few hours of Timothy Piazza's life.

Scicchitano said the footage shows Piazza was clearly injured after his first serious fall, at 11:22 p.m. Meanwhile, Piazza was dying, suffering from head injuries and internal bleeding.

The hearing being held today will determine if there is enough evidence for the case to head to trial. Fraternity members did not call 911 until the morning of February 3, about 12 hours after Piazza's fall, according to a report on the grand.

"He looked dead, he looked like a corpse", said State College Police Detective David Scicchitano.

The video included Piazza stumbling through the house before he was found, hours later, in the basement.




His father, Jim Piazza, rocked back and forth quietly in the front row of the courtroom as he heard his final hours described. The parents of Piazza were in court but bolted from the room before the video presentation.

His lawyer, Rocco Cipparone Jr., said Bonatucci never handed any alcohol to Piazza that night and was not involved in the discussions of whether to call for help.

The Piazza family is also reportedly planning on filing a lawsuit against fraternity members and the university.

Piazza consumed what prosecutors said was a life-threatening amount of alcohol during a hazing ritual at the house in State College. A pathologist said he had severe head trauma and a ruptured spleen.

By that time, Piazza had "lost all color", and some of the fraternity members thought he may have died, Scicchitano said. Investigators say his blood alcohol level was between.28 and.36.

Penn State banned the fraternity after concluding it had engaged in "a persistent pattern" of excessive drinking, drug use and hazing.

Penn State President Eric Barron said, "There are other measures being discussed and will be instituted over time - all with a focus on prevention, monitoring and enforcement".
