Another US appeals court refuses to revive Trump travel ban

A federal appeals court on Monday upheld an injunction blocking parts of Trump's executive orders - the third time the courts have ruled against one of Trump's most notorious campaign pledges.

President Donald Trump criticized the US 9th Circuit Court of Appeals Tuesday for upholding a block on his revised travel ban at, what he called, "such a risky time in the history of our country".

And now, the fight is on the Supreme Court's doorstep. The White House said it is confident the high court will uphold Trump's executive order. The court said the president was required to consult with Congress in setting the number of refugees that would be allowed into the country in a given year and could not decrease that number mid-year.

Even prior to Monday's ruling, the 4th Circuit decision was on the fast track to the Supreme Court after the Trump administration appealed the ruling in an emergency request on June 1.

The lower court blocked the administration from enforcing the order entirely, on the grounds that it violates the First Amendment's prohibition on government establishment of religion. The revised version allowed current visa and green card holders to continue traveling, removed Iraq from the list of targeted countries and deleted a section that gave preference to Christian minorities in those countries.

Quoting the report, it added that citizens from the countries targeted by Trump's ban are "rarely implicated in US -based terrorism".




The president then rewrote his executive order rather than appeal to the U.S. Supreme Court at that time. The 4th Circuit found the policy unconstitutional on that basis.

On Monday, a three-judge panel of the Ninth Circuit Court of Appeals ruled against a revised version of the executive order, using the president's tweets against him in making their decision.

The court said the order makes no finding that nationality alone renders classifying a broad class of people as a heightened security risk to the U.S. The judges pointed to a June 5 tweet by Trump saying the executive order was aimed at "dangerous countries".

Several states and civil rights groups challenged the revised ban, saying it remained rooted in discrimination and exceeded the president's authority.

"The President unquestionably violates that command when he issues an Order that disproportionality burdens Muslim-Americans, while denigrating the Muslim faith and making it abundantly clear that the Order's harmful effect on Muslims is far from incidental", Katyal argued. A Maryland court blocked the other half of the order. The ruling comes on the heels of a similar ruling from the United States Court of Appeals for the Fourth Circuit in May.
